Yes, it does make it invalid, he can either get the owner to take the hat of the market for a month and resuggest then, or find another sale (impossible since hat has not sold twice.)

since the owner has it up for sale, watch the trade to see if he sells it, if he doesnt sell it in a month resuggest at the same range, if he sells it, resuggest at new range
