That sale isn't valid. Firstly, it sold in just 1 hour. Secondly you need sellers at 9 refined to lower.

Even if you're representing the whole market here, which doesn't seem to be the case, you'd need to prove that 10 is entirely not viable to remove it completely from the price. Instead, a range might be in order, except even then you only have 1 seller at 9 ref.
