It's a buy listing.
A sale doesn't need to happen, the user is willing to pay 8.33 Refined for the item.
As long as the user keeps the buy listing relatively bumped and has been online on Backpack.tf relatively enough it is valid.
For example if the buyer has been offline for a few days it can be discounted as not a valid buy listing, this one is valid and counters your suggestion.
Also I just noticed your suggestion is less than a 5% change as well, so no matter what your suggestion is invalid.

Even if this is 5% less the drop is needed
3/4 of the 8.33 sellers have been up 3 days and one is 8 days
Point A: A buyer has a valid buy-listing up for 8.33 Refined. This counters your suggestion, you can't deny or fight that point. It's a fact.
Point B: It is a rule that suggestions have to be more than a 5% change in the price, yours is less than a 5% change, this point cannot be fought either. It is a fact, a rule.

A buyer at a price doesn't automatically counter that price, use common sense, it rather proves 8.33 to be a common trading point. This is a <5% change but since it's a change by at least a rec it is perfectly fine.
